UPCHURCH Mrs. Lillian R. Upchurch of Newnan passed away Monday, June 22, 2009. She is preceded in death by her husband, John B. Upchurch; son, Larry Whitt and is survived by her daughter, Patricia Whitt Stoner and her husband Bob of Newnan; sister, Sara Gilbert of Fayetteville; brothers, Edward Reaves of Attalla, AL, James Reaves of Attalla, AL; grandchildren, Ashley Agan Frazier and her husband Matt, Rodney Whitt and his wife Rhonda; great grandchildren, Olivia, Victoria and Blake; many nieces and nephews. Funeral services will be held Thursday, June 25, 2009 at 2 o’clock in the Chapel of Parrott Funeral Home with Rev. Ray King and Chaplain Dan Akins officiating. Interment Holly Hill Memorial Park. He is survived by Brenda Baker, Fairburn; son, Rodney and Ronda Whitt, Hampton ;mother, Lillian Upchurch, Newnan; sister, Pat and Bob Stoner, Newnan; niece, Ashley Agan; step-children, Jeanette Bood , Locust Grove; Lisa Ward, Kennesaw ; Howard Baker, Fairburn ; grandhildren, Olivia and Blake Whitt ; Caitlin and Isabel Bood ; Rebecca and Joseph Bearden; Michael Baker. To All to whom these Presents shall come, Greeting.
Know Ye, That We, for and in Consideration of the Sum of Fifty Shillings for every Hundred Acres hereby granted, paid into our Treasury by ANNEY NICHOLS have Given and Granted, and by these Presents do Give and Grant unto the said ANNEY NICHOLS a Track of Land, containing Two hundred fifty Acres, lying and being in our County of Johnston. On the North side of Swift Creek on both sides of Holders Branch Beginning at a stake John Dodd’s corner the South side said Branch runs thence along his lines West one hundred poles crossing said Branch to a red Oak thence North Ninety Poles to Red Oak thence East Three hundred Poles to a Pine then South one hundred and fifty six poles to a Post Oak near Charles Parrishes corner, then West two hundred poles to a stake in John Dodd’s line then along said line North to the Beginning as by the Plat hereunto annexed doth appear; together with all Woods, Waters, Mines, Minerals, Hereditaments, and Appurtenances’, to the said Land belonging o appertaining; To hold to said ANNEY NICHOLS his Heirs and Assigns, forever. Yielding and paying to us such Sums of Money yearly, or otherwise, as our General Assembly from Time to Time may direct. Provided Always, that the said ANNEY NICHOLS shall cause this Grant to be registered in the Register’s Office of our said County of Johnston within Twelve Months from the Date hereof, otherwise the same shall be void and of no Effect.

Know all men by these Presents that I Willis Watson of the State aforesaid and County of Johnston for and in consideration of the sum of thirty two pounds ten shillings to me in hand paid by NOAH NICHOLS of the State aforesaid, County of Johnston, have granted, Bargained and sold and by these presents doth grant Bargain and sell unto the said NOAH NICHOLS one half acre Lot of Land lying in the town of Smithfield know in the plan thereof by number twenty nine which said half acre of land the said Willis Watson doth warrant and __? unto the said NOAH Nichols his heirs and assigns forever against the claim right or title of any person or persons claiming by __? or ___?virtue of these Presents. In Witnesses __? of the said Willis Watson doth here unto __?his hand and Seal this 22nd day of April ___? 1814.

This Indenture made this 20th day of February in the year of our Lord One Thousand Eight Hundred and Nineteen. Between Samuel Carr of the State of North Carolina and County of Johnston of the one part and MOSES NICHOLS of the same State and County aforesaid of the other part. Witnessed that the said Samuel Carr for and in consideration of the sum of One Hundred Dollars to him in hand paid at and before the signing and Sealing of these Presents and receipt and payment whereof is hereby acknowledged that I am therewith fully satisfied contented and paid have given granted bargained __? sold unto him the said MOSES NICHOLS his Heirs and Assigns forever a certain piece or parcel of Land situated lying and being n the aforesaid County __? near the head _____? of Mingo. Beginning at a small White Oak said Carr’s corner in Dixon line and runs South said line N 37. East 80 poles to red oak his corner by the road then with his line S.57 E. 126 poles to a stake the Beg. of the Patent then N 126 Poles crossing Mingo to a stake then W 71 W 81 poles to Water Oak then N 21 Poles to a stake then W. 190 poles to pine in the road, then __? the patent S110 poles to a stake in the Patent line then with said line East to the Beginning containing one hundred Fifty Acres, being part of a Patent granted to Needham, began for 250 acres, dated 16th November 1790. To have and to hold the aforesaid land and premises with all and singular the privileges profits benefits and appurtenances thereunto belonging or in ___? appertaining unto him the said MOSES NICHOLS his Heirs and Assigns forever, and the said Samuel Carr doth for myself any Heirs, __? and Adm. covenant and agree to Warrant and forever defend the said Land and premises free and clear from or against the lawful claim of any manner of persons, whosoever, unto him the said MOSES NICHOLS his heirs and assigns forever. Witnesses hereof I the said Samuel Carr have hereunto set my hand and affixed my Seal the day and State above written.

This Indenture made the 21st day of January in the year of our Lord One thousand Eight Hundred and Seventeen Between MOSES NICHOLS and Samuel Carr both of the State of North Carolina and County of Johnston of the one part and Patrick Dixon of the State aforesaid and County of __? the other part. Witnesses that the said MOSES NICHOLS and Samuel Carr for and in consideration of the sum of One Hundred Pounds to them in hand paid at and before the signing and Sealing of these Presents the receipt and payment whereof is hereby acknowledged that we are there with fully satisfied, contented and paid have given granted, bargained a bind ___? and sold unto him the said Patrick Dixon his Heirs and assigns forever, a certain piece or parcel of land situated lying and being in the aforesaid County of Johnston on the West side of Little Mingo, on both sides of the road. Beginning at a small red oak said Carr corner and runs his and Tomlinson’s line N. 35, E 127 poles to an Oak by the road side then Tomlinson line again S 55 E, 127 poles to a stake then wit Adams line, S 35, W 127 poles to the Beginning. Containing One Hundred Acres. Being a track of land granted to William Rials? 29th April 1768 to Patrick Dixon his heirs and assigns forever to Have and to hold the aforesaid land and premises with all and Singular the privileges profits benefits and appurtenance there to belonging or in anywhere appertaining unto him the said Patrick Dixon, his heirs and assigns forever and we the said MOSES NICHOLS and Samuel Carr doth covenant and again to warrant and forever defend the said land and premises free and clear from or against the lawful claim of any person or persons.

This Indenture made this twenty eight day of March in the year of our Lord One Thousand Eight Hundred and twenty eight Between Jesse Adams and Hardy Adams exec. for the Estate of Sam’l Carr deceased of the County of Johnston and State of North Carolina of the one part and MOSES NICHOLS of the County State aforesaid of the other part. Witnesses that the said Jessie and Hardy for the consideration of the sum of eighty two dollars to them in hand paid the said whereof the said Jessie and Hardy doth hereby acknowledge and themselves there with satisfied and paid __? sold and conveyed and by these presents doth convey assign _________________________________? the said MOSES NICHOLS a certain piece or parcel of land situated lying and being in the County and State aforesaid Beginning at a red oak Patrick Dixon corner then 55 E, 127 poles ___?stake 35 W. 127 poles along Hardy Adams and William Ryals line to a stake in William Ryals line then N 55 W 127 poles to a stake thence to the beginning. Containing one hundred acres to him the said MOSES NICHOLS, his assigns forever and we the said Jessie and Hardy __________________________________________________________.
